The New Mexico Medical Board is responsible for protecting the health and safety of the public. As part of that responsibility the Board evaluates complaints against medical doctors (MDs) and physician assistants (PAs) that allege unprofessional conduct, unethical conduct, or other violations of the Medical Practice Act. (See Section 61-6-15)
If anyone believes that a MD or PA poses a danger to the public safety, the Board encourages that person to file a complaint. All complaints must be submitted in writing and must have an original signature. The
complaint form includes information about the MD (or PA), information about the patient, and a description of the conduct that is the subject of the complaint. In addition to the complaint form, we also require a signed “Release of Medical Records” form and/or a special form, if necessary, of “Consent to Release Medical Records Concerning Mental Health or Developmental Disability.”
When the Board receives a written complaint it goes directly to the investigative staff. The Board investigates all complaints over which it has jurisdiction, or the authority to act. All information and all records kept in the investigation of a case, including medical records, staff reports, investigative reports, etc., are confidential and are not available to the public unless the matter goes to a formal hearing.
If, following a thorough investigation and review, the Board determines there is reason to believe that the MD or PA has violated the law, formal public proceedings are started. The MD or PA has rights to an attorney, a public hearing to call witnesses on his behalf and to cross-examine the person who complained. After the public hearing the Board makes a decision whether or not there has been a violation of the law. If a violation has occurred, the Board may discipline the MD or PA, including revoking the license to practice.
